One of the sectors for which Artificial Intelligence applications have been considered as exceptionally promising is the healthcare sector. As a public-facing sector, the introduction of AI applications has been subject to extended news coverage. This article conducts a quantitative and qualitative data analysis of English news media articles covering AI systems that allow the automation of tasks that so far needed to be done by a medical expert such as a doctor or a nurse thereby redistributing their agency. We (...) investigated in this article one particular framing of AI systems and their agency: the framing that positions AI systems as replacing and outperforming the human medical expert, and in which AI systems are personified and/or addressed as a person. The analysis of our data set consisting of 365 articles written between the years 1980 and 2019 will show that there is a tendency to present AI systems as outperforming human expertise. These findings are important given the central role of news coverage in explaining AI and given the fact that the popular frame of ‘outperforming’ might place AI systems above critique and concern including the Hippocratic oath. Our data also showed that the addressing of an AI system as a person is a trend that has been advanced only recently and is a new development in the public discourse about AI. (shrink)

Neste trabalho, nosso objetivo foi expor a relevância das bases teórico-metodológicas da história da educação do tempo presente e desta para a pesquisa histórico-educacional. Partimos dos alicerces da história do tempo presente, destacando alguns conceitos construtores desse campo oriundos de autores como Rémond, Bédarida e Chartier, entre outros. A seguir, trabalhamos os avanços e os desafios enfrentados pelos pesquisadores desse campo. As fontes disponíveis para as pesquisa da história da educação do tempo presente foram destacadas, argumentando que a abundância delas (...) e a proximidade do pesquisador em relação ao tempo da sua ação não facilitam a pesquisa e não diminuem sua necessária rigorosidade. Os alicerces da história do tempo presente, os desafios, os avanços, suas fontes abundantes e sua aplicação rigorosa constroem uma nova epistemologia para a história da educação, marcada pelas incertezas que referenciam a centralidade da problematização na pesquisa histórica. Toda essa argumentação é reforçada pela idéia originária de que a educação, como uma prática social, exige de seus pesquisadores a consecução dos depoimentos orais, das informações e de todos os tipos de documentação oriundas dos sujeitos que a fizeram/fazem. Dans ce travail, nous avons eu pour objectif de montrer et de défendre l’importance de l’histoire de l’éducation du temps présent pour la recherche historico-éducative. Nous avons pris comme point de départ les fondements de l’histoire du temps présent, en soulignant quelques concepts constructeurs de ce champ créés par des auteurs tels que Rémond, Bédarida et Chartier, entre autres. Ensuite, nous avons analysé les avancements et les enjeux affrontés par les chercheurs de ce domaine. Les sources disponibles pour les recherches sur l’histoire de l’éducation du temps présent ont été mises en relief, en considérant le fait que leur abondance et la proximité du chercheur par rapport au moment de son action ne facilitent pas son travail ni en diminuent la rigueur nécessaire. Les fondements de l’histoire du temps présent, les enjeux, les avancements, ses sources abondantes et son application rigoureuse construisent une nouvelle épistémologie pour l’histoire de l’éducation marquée par les incertitudes qui fondent la centralité de la problématisation dans la recherche historique. Toute cette argumentation est renforcée par l’idée originaire selon laquelle l’éducation, en tant que pratique sociale, exige de ses chercheurs la consécution des témoignages oraux, des informations ainsi que de toute sorte de documents provenant des sujets qui l’ont faite/la font. Neste texto pretendo dizer alguma coisa sobre a criação, referida por Porchat como uma epopeia, e consolidação do CLE e do Programa de pós-graduação em Filosofia da UNICAMP. O Prof. Porchat chegou à UNICAMP, em 1975, e trouxe consigo um pequeno projeto, que submeteu ao então reitor da Unicamp, Prof. Zeferino Vaz. A proposta contemplava a implantação de um Centro de estudos e pesquisas nas áreas de Lógica, Epistemologia e História da Ciência bem como a criação de um programa de (...) pós-graduação em Lógica e Filosofia da Ciência. Tal projeto, além de preencher uma grande lacuna, converteria a Unicamp, na década de setenta, num local privilegiado de encontro e diálogo entre filósofos, lógicos, historiadores, sociólogos, matemáticos, físicos, psicanalistas até então dispersos nos vários centros universitários do país. O Prof. Zeferino entusiasmou-se com a ideia já na primeira reunião e meses depois uma dezena de filósofos já havia sido contratada para a implantação do CLE e também do Curso de Pós-Graduação em Lógica e Filosofia da Ciência junto ao Departamento de Filosofia. A marca que o Prof. Porchat imprimiu neste programa, neste período, e que o caracterizava era a atmosfera de debate e de discussão que se instalou ali. (shrink)

This paper challenges the view that contentment leads to personal freedom and autonomy and argues for a relational and exercise concept of de facto freedom in the Zhuangzi 莊子. I first review influential interpretations of freedom in the Zhuangzi that equate freedom with contentment and nonfrustration, starting with Guo Xiang's 郭象 (d. 312 CE). By putting these interpretations in dialog with contemporary social philosophy (Christman, Meyers, Pettit, Elster, and Khader), I reflect on the two seminal problems of the psychologizing causal (...) and procedural approaches that allow the interpretation of freedom as contentment: the “happy slave” problem and the “sour grapes” problem. Proving this account of freedom inadequate, I argue for a different interpretation of freedom in the Zhuangzi that resembles a weakly substantive and constitutive account of freedom and autonomy in modern‐day social philosophy terms, such as Marina Oshana's. The theory of freedom that I analyze in the Zhuangzi, however, helps us correct the risk of material determinism of the constitutive account, offering a description of relational freedom and autonomy as constituted by socio‐material conditions but not determined by them. A discussão por mudanças na educação brasileira é tema recorrente desde a “descoberta” do Brasil. Com o advento da pandemia do novo Coronavírus, percebeu-se, por exemplo, a intensificação da tentativa de regulamentar o homeschooling no Brasil como um modal educacional, justificando, assim, a necessidade de discussão a respeito de uma propositiva de educação escolar domiciliar. Nesse viés, o presente estudo teve por objetivo compreender os elementos constitutivos do homeschooling no Brasil. Com base em pressupostos críticos e fazendo uso de estudo (...) bibliográfico e análise documental, o corpus teórico utilizado foi de Lubienski (2007), Roldão (2007), Saviani (2003; 2008), entre outros, tendo como referência o levantamento nas bases de dados ANPEd, CAPES e BDTD. Como recorte temporal no período 2019-2021, concluiu-se que o ensino domiciliar seria um retrocesso para a educação brasileira, aumentando a desigualdade social outrora existente, além de acarretar perdas irreparáveis para os estudantes. A través del presente artículo se realiza un estudio sobre el Movimiento de Vida Independiente y la figura del Asistente Personal en España. Dicho movimiento defiende una visión distinta sobre el mundo de la discapacidad, planteada por las propias personas con diversidad funcional que fomentan su propia autonomía e independencia y apuestan, por tanto, por una manera diferente de gestionar las políticas públicas de atención a la dependencia. La figura del Asistente Personal, poco desarrollada por las Administraciones Públicas en nuestro (...) país, supone una herramienta en el proceso emancipador y de empoderamiento de las personas con discapacidad, con la adopción de medidas no medico-rehabilitadoras, encontrándose en la misma línea y principios propugnados por el Movimiento de Vida Independiente. Several studies have illuminated how processing manual action verbs (MaVs) affects the programming or execution of concurrent hand movements. Here, to circumvent key confounds in extant designs, we conducted the first assessment of motor–language integration during handwriting—a task in which linguistic and motoric processes are co‐substantiated. Participants copied MaVs, non‐manual action verbs, and non‐action verbs as we collected measures of motor programming and motor execution. Programming latencies were similar across conditions, but execution was faster for MaVs than for the other (...) categories, regardless of whether word meanings were accessed implicitly or explicitly. In line with the Hand‐Action‐Network Dynamic Language Embodiment (HANDLE) model, such findings suggest that effector‐congruent verbs can prime manual movements even during highly automatized tasks in which motoric and verbal processes are naturally intertwined. Our paradigm opens new avenues for fine‐grained explorations of embodied language processes. (shrink)

Mercedes Valmisa turns our attention to the relations between truth and practice in classical Chinese philosophy. In this tradition, truth is conceived of, in a pragmatic-like spirit, as a series of embodied beliefs and perspectives that lead to fitting dispositions, emotions, and actions (regardless of whether they accurately describe the world, or whether there are other competing beliefs and perspectives that equally accurately or inaccurately describe the world). This means that we should care about truth because of its normative (...) power to guide our behavior in the most fitting way, not because of a theoretical interest in accurately describing reality. Valmisa Oviedo traces the development of this conception of truth in the Mohists and Zhuangists, leading to two radically different sociopolitical and ethical positions: the Mohists used single-truth discourses to enforce ideological monopolies that could not allow pluralism in values, norms, beliefs, and practices, while the Zhuangists warned us against the dangers of such dogmatism. The first contribution, by Mercedes Valmisa, begins by repositioning the Zhuangzi 莊子 as a whole within pre-Qin thought under the impact of newly excavated materials. Moving away from the traditional classification of texts according to schools, it focuses instead on varying approaches to life issues. Centering the discussion on life situations and changes we have no control over, including the unpredictable vagaries of fate (ming 命), it outlines several typical responses. One is adaptation, finding ways to go along with (...) what life demands, and even availing oneself of the new opportunities it brings about. Another is a turning inward, a focus on the inner self, holding on to ethical and other standards and making sure on does the right thing regardless of the outcomes of one's actions. While the former appears in several chapters of the Zhuangzi, notably in chapter 6, the latter is central to the Qiongda yishi 窮達以時 (Failure and Success Depend on Opportunity), a manuscript excavated at Guodian. However tempting it may be to characterize one approach as Daoist and the other as Confucian, they both appear within the Zhuangzi together with a third approach to fate, showing the fluidity of philosophical discussion and the futility of thinking along the lines of traditional boundaries. In my dissertation, I explore how emotions operate under conditions of injustice. Specifically, my interest is in how one should deploy their emotions in order to combat patriarchally informed, affective ways of making sense of and responding to the social world. My dissertation consists of the following three papers. In the first paper, “Vindictive Anger,” I argue for two claims. First, that anger is not necessarily made morally worse whenever and to the extent that it involves a desire for payback. (...) Second, that in certain cases, anger’s retributive component is precisely what moralizes the emotion. Victims of sexual violence, I argue, paradigmatically deploy their anger as a way of getting their transgressor or, in some cases, the broader moral community, to more fully understand, through affect, the wrongness of their action. One can see this occur in the anger expressed by Chanel Miller in her victim’s impact statement, read aloud during the case of People v. Turner. When anger functions in this way, I propose, it serves to moralize the emotion. In the second paper, titled “Feminism and Suspect Femininity,” I ask how feminists should feel towards women who conform to suspect norms of appearance, and of hyper-femininity in particular. I present a novel type of empathy – proleptic empathy – which avoids treating women as either pitiful victims or as accomplices deserving of harsh moral criticism. Proleptic empathy requires switching back and forth between two types of imaginings: on the one hand, simulating what it is like to be in the woman’s shoes on the assumption that her suspect behavior stems from her will. On the other, simulating what it is like to be in the woman’s shoes on the assumption that her suspect behavior stems from external cultural influences. In the third paper, “Transitional Moral Contexts,” I address how one should feel towards the perpetrators who figure in the cases that have gone by the language of ‘grey rape’ or ‘bad sex’. These cases are ones that are rife with disagreement, especially amongst members of the moral community, who even disagree over whether they ought to count as cases of ‘sexual assault’ or ‘rape’. My suggestion is that the reason we have such difficulty adjudicating individuals’ responsibility for cases of bad sex is because these are instances of transitional moral contexts where what it is to act morally is in the process of being actively negotiated by the moral community. With this analysis in place, I present reasons for and against deploying shame against those who falter in these cases. (shrink)

The Escuela Feminista de Teología de Andalucía [the Andalusian School of Feminist Theology], held a conference titled ‘Feminine Mysticism and Counterculture: A Rebellious Genre’ October 15-17, 2009 at the University of Seville. This annual seminar is held thanks to an agreement between the University of Seville and EFETA, with the direct support of the research group ‘Escritoras y Escrituras,’ whose principal researcher is Mercedes Arriaga. The guest of honour at this year’s conference was Lisa Isherwood, who kindly presented EFETA (...) with the opportunity to publish some of the seminar’s papers in Feminist Theology, and who we here in Spain thank wholeheartedly for her contributions. O artigo apresenta uma visão panorâmica dos documentos da Conferência dos Bispos latino-americanos, realizada em Medellín, no ano de 1968. Inicialmente, distingue o Medellín histórico do Medellín simbólico. A seguir, recorda como Assembleia foi bem preparada e se realizou de forma participativa. Então, demonstra a relação de continuidade com o Vaticano II. De outro lado, Medellín não foi uma mera aplicação do Concílio, mas sim uma recepção criativa. No núcleo do artigo, demonstra-se como o método VER-JULGAR-AGIR foi utilizado nos vários (...) documentos de Medellín, alocados em três eixos: promoção humana, evangelização e crescimento da fé, Igreja visível e suas estruturas. Por fim, ele se detém em dois documentos: Pobreza na Igreja e Liturgia. Encerra-se com algumas conclusões abertas, de caráter pastoral. (shrink)

Desde seu início a pedagogia de Paulo Freire se alimenta das suas leituras de base, convergências e conexões com outros pensadores das ciências humanas/sociais e da educação. A partir dos ideais do catolicismo progressista e do nacionalismo-desenvolvimentista das décadas de 1950 e 1960 – presentes em suas obras Educação e atualidade brasileira e Educação como prática da liberdade –, do progressismo marxista – presente de maneira crescente em Pedagogia do oprimido, Ação Cultural para a liberdade e outros escritos, Educação e (...) mudança –, passando pelos “escritos africanos”, entre outros, até seu declarado “pós-modernismo progressista” – presente em Pedagogia da esperança –, muitos pensadores influenciaram Freire, em menor ou maior grau. Se Karl Jaspers, Maritain e Lima Vaz et al., assim como os ideólogos do ISEB e John Dewey, entre outros, marcaram suas ideias expostas inicialmente e até a metade dos anos 1960, Hegel e o marxismo “superestrutural” marcam a continuidade desenvolvida em Pedagogia do oprimido. De lá para cá, esta base foi misturada com as convergências e conexões de ideias que vão de Piaget a Gramsci, chegando às possibilidades de complementos, parcerias, extensões temáticas e reinvenções conceituais. Apesar do legado de Paulo Freire resultar dessas leituras, convergências e conexões, seu pensamento-ação nunca se deixou dominar/enjaular por nenhuma escola ou tendência ideológica. Ao contrário, reconhecendo a necessidade fundante de diálogos teóricos permanentes e tecendo uma obra sequiosa de complementações, construiu um pensamento original e crítico que marcou a pedagogia da segunda metade do século XX e, a nosso ver, demonstra uma prospecção atual vigorosa. Portanto, neste trabalho buscamos compreender as bases e as conexões do pensamento político-pedagógico de Paulo Freire, explicitadas ao longo do seu discurso e colocadas nos seus principais livros publicados no Brasil, percorrendo um itinerário de referências bibliográficas, aproximadamente cronológico, de sua produção escrita. Spontaneity is an almost inevitable commonplace in discussions of Daoism, especially the Zhuangzi. The idea that spontaneity is one of the most important values in the Zhuangzi was presented by Angus Graham for the Anglo-European audience, and divulged among Chinese readers by Liú Xiàogǎn 劉笑敢 and Chén Gǔyīng 陳鼓應. Hungarian psychologist Csikszentmihalyi popularly combined Daoist spontaneity with the idea of flow. In the state of flow the person carries out an activity for the sake of the activity itself--autotelically--and acts with (...) complete spontaneity given that none of their movements requires thought or mediation. My study consists of three parts: First, I deal with different definitions of “spontaneous” and of the term that is commonly translated as “spontaneous” in Chinese texts, zìrán 自然 (literally, so-of-itself), as well as its use in the Zhuangzi. I conclude that spontaneity is not part of the axiological project of the Zhuangzi. Instead, we find that the idea of adapting is related to normative human values and behaviors, whereas spontaneity is a term merely descriptive of natural objects. Second, I analyze the famous Zhuangzian stories of skills, which are often quoted to argue for the value of spontaneity. I conclude that the goal of these stories is to develop a new type of vital attitude as “second nature” or “background ability” (John Searle). Since this attitude is mediated and achieved through effort, it is not spontaneous. Third, I explain the confusion between this “second nature” with “spontaneity” in recent scholarship has led to the so-called paradoxes of non-action and spontaneity (Edward Slingerland). I argue that these paradoxes disappear when we understand the different layers of meaning of wú-wéi and zìrán in the early Chinese textual context. (shrink)

Les femmes communistes espagnoles reconstituèrent leur organisation en 1945, dans l’exil français, afin de mobiliser les réfugiées dans la résistance antifranquiste. Les figures d’héroïnes évoquées dans la revue Mujeres Antifascistas Españolas, tiennent une place importante dans la culture politique de ces femmes. Des récits, où réalité et fiction se mêlent, mettent en scène vierges guerrières et mères héroïques. Si l’héroïsation individuelle ou collective confine parfois au mythe, sans remettre en cause le système traditionnel de genre, elle permet d’inscrire ces héroïnes (...) dans l’histoire de l’Espagne et dans la mémoire collective des opposants au régime du général Franco. 研究早期中国哲学的学者均普遍认为，缺乏作者和思想学 派的资料，对以哲学为本的研究非常不利。就着这个观点，本文提出异议: 汉学研究所提供的文献、文学、语言、历史的知识，可融贯于早期中国哲学 的研究，并产生良好的影响。蒋韬在 2016 年提出了“汉学挑战”的论述。就此，本文论证，汉学正好 提供一个机会，结合不同的研究方法及角度，从而更有效地处理具体的哲 学议题。我以自己对“命”的研究为例，解释如何以多个文本为基础，梳理 哲学问题，做“没有作者的哲学”，并显示:融贯汉学研究所提供的各种方 法、知识、研究工具，不仅无损哲学研究，更为其注入新气象。我采取了“后学科”的研究角度:受到前学科文化(例如早期中国文 化)的启发，“后学科”的角度在提问时，往往从整体出发，不囿于各个学科 的既定模式和分类;并开辟新路向，容纳创意，追寻意义，以产生可行的新 联系。 Some scholars of early Chinese philosophy see the knowledge provided by Sinology as a challenge to the development of sound philosophical enquiry. What Sinology tells us about the historical context and the textual, material, and intellectual culture of the period is considered detrimental for engaging in philosophical research, reason why these scholars believe that Chinese philosophy must separate itself from Sinology. I argue that Sinology does not offer (...) a challenge but an opportunity to engage with a multitude of approaches and methods to more efficiently address philosophical problems and questions. I offer my own research as an example of how to integrate the knowledge and analytical tools offered by Sinology in a philosophical study of early China. Focusing on the most crucial Sinological challenge--the challenge to the notions of “book” and “author"--I show that using the methods and knowledge provided by other disciplines does not jeopardize but, much to the contrary, invigorates and revitalizes philosophical research. My perspective is post-disciplinary: inspired by pre-disciplinary cultures such as early China, post-disciplinarity engages inquiry holistically, suspending the patterns and categories established by discrete disciplines, forging new paths for creativity and the search of meaning, and allowing new viable connections to emerge. Philosophers sometimes wonder whether academic work can ever be truly interdisciplinary. Whether true interdisciplinarity is possible is an open question, but given current trends in higher education, it seems that at least gesturing toward such work is increasingly important. This volume serves as a testament to the fact that such work can be done. Of course, while it is the case that high-level theoretical work can flourish at the intersection of dance and philosophy, it remains to be seen how we (...) might share this with undergraduate students. For many of us in philosophy and dance, a large number of the students we teach are neither philosophy nor dance majors. As such, we are familiar with the challenge of convincing our students to care about our fields. Both philosophy and dance, qua disciplines on a college campus, face similar challenges. These disciplines are often deeply misunderstood, frequently presumed to be “impractical” (a powerful, but confused objection), intimidating, and frivolous. In this chapter, we offer an account of the course we co-taught at Southern Utah University in the Spring of 2016 titled “Movement and Space” as a rough framework for how to introduce the intersection between philosophy and dance to students. We simultaneously attempted to break students of their misconceptions about philosophy and dance, and worked to engage students and professors alike in a truly interdisciplinary educational experience. Treating philosophy as an embodied endeavor, and employing philosophical concepts through the act of dance encouraged students and faculty alike to rethink the fundamental nature of aesthetics. Philosophy of action in the context of Classical China is radically different from its counterpart in the contemporary Western philosophical narrative. Classical Chinese philosophers began from the assumption that relations are primary to the constitution of the person, hence acting in the early Chinese context necessarily is interacting and co-acting along with others –human and nonhuman actors. This book is the first monograph dedicated to the exploration and rigorous reconstruction of an extraordinary strategy for efficacious relational action devised by Classical (...) Chinese philosophers in order to account for the interdependent and embedded character of human agency –what the author has denominated “adapting” or “adaptive agency” (yin 因). As opposed to more unilateral approaches to action also conceptualized in the Classical Chinese corpus, such as forceful and prescriptive agency, adapting requires great capacity of self and other-awareness, equanimity, flexibility, creativity, and response, which allows the agent to co-raise courses of action ad-hoc: unique and temporary solutions to specific, non-permanent, and non-generalizable life problems. Adapting is one of the world’s oldest philosophies of action, and yet it is shockingly new for contemporary audiences, who will find in it an unlikely source of inspiration to deal with our current global problems. This book explores the core conception of adapting both on autochthonous terms and by cross-cultural comparison, drawing on the European and Analytic philosophical traditions as well as on scholarship from other disciplines, opening a brand-new topic in Chinese and comparative philosophy. A dragon needs the clouds and the wind in order to fly. What happens when we too relinquish individualistic reasoning?

In this article, the author compares two Spanish translations of Virginia Woolf’s A Room of One’s Own. Taking into account that Spanish is a language in which words referring to human beings have a feminine and a masculine form, and grammatical gender corresponds to sex, all translators must interrogate the sex of the referent in order to translate gendered words. They are thus compelled to assign sex to genderless forms in the source text. Patriarchal translation has a long tradition of (...) devaluing and excluding the feminine in this process, as the author demonstrates here by revealing how Jorge Luis Borges translated the pronouns you and we in Woolf’s essay. In contrast, in her feminist translation of the essay, María Milagros Rivera-Garretas not only chooses the gender which most accurately represents the likely intended meaning of the source text, but recovers its message and legacy. Analizamos dos momentos constitucionales en la obra de Juan Bautista Alberdi a partir de sus lecturas de Théodore Jouffroy y Benjamin Constant. En el primer caso, ponemos en relieve la concepción filosófico- moral del derecho así como el modelo de publicista que fue Jouffroy para el “joven” Alberdi de 1837. Alejandro Tiana Ferrer es catedrático de historia de los Sistemas Educativos de la UNED. Ha ocupado entre otros cargos los de director del Centro de Investigación y Documentación Educativa (CIDE), creador y primer director del Instituto Nacional de Evaluación Educativa (INCE), presidente de la Asociación Internacional para la Evaluación del Rendimiento Educativo (IEA) y, hasta hace unos meses, Secretario General de Educación del Ministerio de Educación y Ciencia, donde ha diseñado y empezado a implementar una nueva ley de educación. Es (...) pues, la persona más adecuada para hablar de evaluaciones internacionales y sistemas educativos. Porque tiene una visión global y rigurosa de la educación en el mundo, una experiencia en primera persona, desde la toma de decisiones, de la realidad del sistema educativo español y un conocimiento profundo, desde dentro de las instituciones, de lo que son las evaluaciones internacionales y cuál es su sentido para mejorar la educación. Der bedeutendste Vertreter der Stoa in Rom, Lucius Annaeus Seneca, der Erzieher Neros, hinterließ ein umfangreiches philosophisches Werk. Es enthält bemerkenswerte theoretische Äußerungen über die natürliche Veranlagung der Frau und das Verhältnis der Geschlechter, eindrucksvolle Frauenporträts sowie zwei Trostschriften, die sich explizit an zwei Frauen richten. Das hier zutage tretende Frauenbild Senecas erscheint auf den ersten Blick zwiespältig und inkonsequent. Die Untersuchung der einschlägigen Passagen, die traditionelles römisches Denken, stoische Lehre, pädagogische Absicht und persönliche Erfahrung spiegeln, zeigt aber, daß der (...) Philosoph bei der Beurteilung des menschlichen Sittenverhaltens keine geschlechtliche, sondern eine graduelle Differenzierung vornimmt, die ethische Gleichheit von Mann und Frau, die Forderung nach gleicher Erziehung und Bildung vertritt und der Frau in demselben Maße wie dem Mann die Befähigung zukommen läßt, sich durch die Beschäftigung mit der Philosophie dem stoischen Ideal anzunähern. La oratoria martiana es objeto de estudio en la educación superior cubana con el propósito de destacar los principios éticos que el tribuno enarbola, pero se obvia la valoración de la poesía en la que estos se sustentan. Demostramos en este trabajo cómo ambos aspectos se relacionan a través del análisis de algunos de sus discursos políticos más importantes.

The major social, legal and judicial sensitization on the need to eradicate genderbased violence demands a suitable and effective response from all Public Institutions to safeguard the rights of the women. The principal aim of this article is to highlight the legislative solution given to this problem in relation with immigrant women (third-country nationals). Spanish and EC lawmakers have set out rules relating to gender-based violence for three groups of women: a) Married women or registered partners of European Union, EEE, (...) Swiss or Spanish citizens; b) Women married to third-country nationals; c) Women who are in Spain, married or not, in an irregular situation. The legislation analyzed in this paper regulates only the administrative situation to which women can accede when they are the victims of gender-based violence. That is to say, what types of authorizations can be granted and what possible “benefits” can be obtained, but only in the documentary area. Neither the penal or civil response to gender-based violence is analyzed. (shrink)
